How We Handle Family Matters

01
Confidential Initial Consultation

A private consultation to understand your situation, clarify legal options, assess grounds, and establish a strategy tailored to your specific family circumstances and emotional wellbeing.

02
Document Preparation & Evidence Compilation

Gathering and organizing all relevant documents — marriage certificate, property records, income proof, communication records, medical reports — building a robust evidentiary foundation.

03
Pre-Litigation Mediation Attempt

Before filing, we explore whether a negotiated or mediated settlement serves your interests — particularly in custody and maintenance matters where amicable resolution often yields the best long-term outcomes.

04
Filing & Interim Relief Applications

We file petitions in the appropriate court and simultaneously apply for interim relief — protective orders, custody arrangements, maintenance pendente lite — to safeguard your immediate interests.

05
Trial Advocacy & Final Decree

Where matters proceed to trial, we conduct thorough examination of witnesses, present documentary evidence, and advance legal arguments — pursuing the strongest possible outcome at every stage.

06
Enforcement & Appeals

We ensure decrees and orders are enforced through execution proceedings and contempt applications, and pursue appeals before the High Court or Supreme Court where necessary.

Family Law — Common Questions

Mutual consent divorce under Section 13B HMA typically takes 6–18 months, including the mandatory 6-month cooling-off period (waivable by the Supreme Court in exceptional cases per Amardeep Singh v. Harveen Kaur). Contested divorce can take 3–7 years depending on grounds, evidence, and court workload. We work to expedite at every procedural stage through effective case management.
Indian courts apply the "best interests of the child" doctrine under Section 26 HMA and the Guardian and Wards Act. There is no automatic preference for either parent. Courts consider the child's age, preferences (especially for older children), each parent's financial stability, emotional bond, and ability to provide care. Joint custody arrangements are increasingly being granted by High Courts.
Yes. Under Section 24 HMA, a spouse can claim interim maintenance if their income is insufficient to maintain the standard of living enjoyed during marriage. The Supreme Court in Rajnesh v. Neha (2021) laid down comprehensive guidelines for maintenance calculation considering income of both parties, lifestyle, and needs. A working wife can still claim maintenance if her income is substantially lower than her husband's.
A complaint under the DV Act, 2005 is filed before a Magistrate Court. The court can issue Protection Orders (s.18), Residence Orders (s.19), Monetary Relief Orders (s.20), and Compensation Orders (s.22) — often within 3 days in emergency cases. Simultaneously, a criminal FIR under BNS Section 85/86 can be filed at the local police station. We assist in filing both routes and obtaining immediate interim protection.
Prenuptial agreements are not governed by specific legislation in India and their enforceability is limited. Courts generally do not enforce provisions overriding statutory rights such as maintenance or the wife's residence rights. However, prenuptial agreements on financial matters and property division have persuasive value. We draft carefully structured agreements that maximize enforceability within public policy limits.
