Common Questions
Frequently Asked Questions
Is there an AI-specific law in India?
India does not yet have a standalone AI regulation. However, the government has published the National Strategy for Artificial Intelligence (NITI Aayog), and AI-related provisions are emerging in the DPDP Act 2023, IT Act amendments, and sector-specific regulations (RBI, SEBI, IRDAI). The EU AI Act and global regulatory trends suggest India will follow with specific AI regulation. Proactive compliance now positions organisations ahead of mandatory requirements.
Who owns the output of a generative AI tool?
This is an evolving legal question globally. Under current Indian copyright law, only works created by a 'person' qualify for copyright protection. AI-generated content without substantial human creative contribution may not be copyrightable. We advise organisations on structuring human-AI collaboration to maximise IP protection for AI-assisted outputs.
How does DPDP Act 2023 apply to AI systems?
AI systems that process personal data are subject to DPDP Act obligations including purpose limitation (data used for training must align with stated purposes), consent management, data minimisation, and the right to be forgotten. Automated decision-making using personal data must comply with transparency and fairness requirements. We advise on DPDP-compliant AI data pipelines.
