How We Approach Consumer Protection Matters

01
Consumer Rights Assessment & Forum Selection

We evaluate your consumer complaint — quantifying the exact loss, identifying the appropriate consumer commission (District/State/NCDRC based on pecuniary value), and assessing whether regulatory escalation (CCPA, IRDAI, RBI Ombudsman) offers a faster parallel remedy.

02
Pre-Complaint Legal Notice

We send a formal legal notice to the opposite party (company, service provider, e-commerce platform) demanding remedy within 15-30 days — often prompting settlement without litigation, while also creating an essential legal record.

03
Complaint Drafting & Filing

We draft a comprehensive complaint with detailed narration, evidence annexures, and quantified claims covering: purchase price, consequential losses, compensation for harassment, and litigation costs — ensuring compliance with Section 35 CPA 2019 requirements.

04
Evidence Compilation

We compile all supporting evidence: purchase receipts, product photographs, service records, correspondence, expert reports, and medical records — presenting a thorough evidentiary case to the Consumer Commission.

05
Commission Hearings & Arguments

We represent clients at all hearings before the Consumer Commission — responding to opposite party's version, cross-examining their witnesses, and presenting comprehensive legal arguments on liability, deficiency, and quantum of compensation.

06
Appeals & Enforcement

Where the Commission's order requires appeal — either to enhance inadequate compensation or to challenge an adverse order — we pursue appeals through all tiers up to the Supreme Court, and enforce favorable orders through execution proceedings.

Consumer Protection — Common Questions

Under the Consumer Protection Act, 2019: District Consumer Commission handles disputes up to Rs.50 lakhs; State Consumer Dispute Redressal Commission handles disputes from Rs.50 lakhs to Rs.2 crores (and first appeals from District Commission); NCDRC (National Consumer Dispute Redressal Commission, New Delhi) handles disputes above Rs.2 crores and first appeals from State Commission. Second appeals from NCDRC lie before the Supreme Court. The pecuniary threshold is based on the value of goods/services paid, not the total compensation claimed.
Under CPA 2019, you can claim: (i) replacement or repair of defective product; (ii) refund of price paid; (iii) removal of deficiency in service; (iv) compensation for loss or injury suffered; (v) punitive damages in cases of gross negligence or willful misconduct; and (vi) litigation costs. In product liability cases (Chapter VI), injured persons can also claim compensation for personal injury and property damage. There is no fixed cap on consumer compensation — amounts are determined based on actual loss, suffering, and deterrence needs.
Yes. The Supreme Court in Indian Medical Association v. VP Shantha (1995) held that medical services fall within the Consumer Protection Act. Patients can file consumer complaints against doctors and hospitals for medical negligence — deficiency in service. The Consumer Commission typically appoints a medical expert committee to assess standard of care. Separately, criminal prosecution for negligence (BNS Section 106, formerly IPC Section 304A) can also be pursued. We coordinate both civil consumer and criminal strategies in medical negligence matters.
The Consumer Protection Act 2019 mandates disposal within 3 months for matters not requiring laboratory analysis, and 5 months where laboratory analysis is required. In practice, District Consumer Commissions dispose matters in 6 months to 2 years. State Commission matters typically take 1–3 years. NCDRC matters can take 2–5 years. We file expedited hearing applications and ensure regular listing to minimize delays.
Yes. Under the Consumer Protection (E-Commerce) Rules 2020, e-commerce platforms are required to have a Grievance Officer and must resolve complaints within 48 hours of registration and redress within 30 days. If the platform fails, you can file a complaint before the District Consumer Commission. Under the new CCPA (Central Consumer Protection Authority) framework, platforms can face penalties up to Rs.10 lakhs for first violations and Rs.50 lakhs for subsequent violations of unfair trade practices including dark patterns.
