How We Approach Civil Law Matters

01
Preliminary Legal Assessment

We conduct a thorough assessment of your civil dispute — reviewing documents, identifying applicable legal provisions, evaluating limitation periods, and advising on the viability and strategy of civil proceedings.

02
Pre-Suit Notice & Negotiation

Where appropriate, we send a formal legal notice under Section 80 CPC or relevant statute — establishing legal standing, creating a record, and opening settlement negotiations before litigation costs escalate.

03
Plaint Drafting & Filing

We draft a comprehensive plaint setting out the cause of action, material facts, reliefs sought, and legal basis — ensuring compliance with CPC pleading requirements and avoiding technical defects.

04
Interim Relief Applications

Simultaneously, we file applications for temporary injunctions (Order XXXIX), attachment before judgment (Order XXXVIII), or appointment of court commissioner — protecting your rights while the main suit proceeds.

05
Evidence & Trial Management

We conduct systematic evidence gathering, examination of witnesses in chief and cross-examination of opposing witnesses, and present documentary evidence and expert testimony before the trial court.

06
Appeals & Enforcement

We pursue first appeals before the District Court, second appeals before the High Court, and letters patent appeals where applicable — and execute decrees through attachment and sale of judgment debtor's property.

Civil Law — Common Questions

Limitation periods under the Limitation Act, 1963 vary: 3 years for most contracts (from date of breach), 12 years for property suits (from dispossession), 1 year for defamation suits, and 1 year for suits against government (after two-month pre-suit notice). Missing the limitation period is fatal unless covered by Sections 5 (sufficient cause), 6 (disability), or 14 (exclusion of time in prior proceedings). We assess limitation meticulously at the outset of every engagement.
Civil suits in India can take anywhere from 1–15 years depending on the court, complexity, and parties involved. Order XXXVII summary suits are designed for 60-90 day disposal. Commercial Court suits under the Commercial Courts Act 2015 have a 12-month mandate. Regular civil suits in District Courts often take 5–10 years. We file appropriate applications for expedited hearing and actively pursue regular listing to minimize delays.
Specific performance under Section 10 of the Specific Relief Act, 1963 is a court order compelling a party to perform their contractual obligations — typically in contracts for sale of immovable property. Courts grant specific performance when monetary compensation is inadequate. The 2018 amendment made specific performance the rule rather than exception for contracts. Critical: specific performance must be sought within 3 years of breach.
Yes. Courts can grant ex-parte temporary injunctions (without notice to the other party) on the same day of filing where there is genuine urgency and irreparable harm — under Order XXXIX Rule 3 CPC. We prepare comprehensive injunction applications with supporting affidavits and evidence that maximize the likelihood of immediate relief. High Courts and Commercial Courts are particularly responsive to urgent injunction applications in clear-cut cases.
Key evidence in property disputes includes: sale deeds, gift deeds, or succession documents establishing chain of title; revenue records (khasra, khatauni, jamabandi); possession evidence (utility bills, photographs, witness testimony); mutation entries; development permits; and survey maps. For encroachment matters, a local commissioner's report ordered by the court is invaluable. We conduct a thorough document audit at the start of every property matter.
